Translation: Sun Daluo's Court Judgment for Sharing Books and Articles

The PRC government sentenced Sun Zhiming (孙志明, who wrote under the alias Sun Daluo (孙大骆)) to one year imprisonment for the crime of "disturbing the peace" (寻衅滋事, also translated as "picking quarrels and provoking troubles") for authoring, publishing, and sharing political books and articles that, according to the court, contained "fake information" about Mao Zedong, Xi Jinping, and the Communist Party. 

Some noteworthy aspects of the judgment:

  • The court did not provide any examples of what it had deemed "fake information."
  • The court did not provide any examples of how Sun's publications had "disturbed the peace."
  • According to the judgment, Sun did not publish anything in mainland China, only distributed his publications inside mainland China through individual copies and private channels (e.g., private WeChat groups).
  • The two main books cited in judgment - "A History of the Political Machinations of Mao Zedong" and "A History of the Political Machinations of Xi Jinping" - were published outside of mainland China in 1998 and 2015, respectively. The government determined retroactively that these were "banned publications" under the "Regulations on the Administration of Publishing."
  • One of the articles cited in the judgment, and apparently the last on Sun published before his arrest - "The Cruelty of the CCP's Power Struggle" (中共权力斗争残酷表) - is just a (seemingly accurate) list of government officials jailed in the wake of the Bo Xilai scandal.
  • Another article cited in the judgment - "Xi Jinping Enters the Underground Command Post to Prepare for Nuclear War" (习近平进入地下指挥所准备核战争) - claimed that the Xi's failure to appear publicly for 10 days was not due to illness, as reported in foreign media, but rather because "The top leaders of the Chinese Communist Party judged that US President Trump might provoke a war before stepping down and might launch nuclear weapons at cities such as Beijing in China."
  • A third article cited in the judgment - "Mao Zedong Set a Trap to Murder Lin Biao" (毛泽东下套谋杀了林彪) - is an essay critiquing "A Reexamination of the September 13 Incident" (林彪事件再考察) by Xiao Gongqin (萧功秦), a history professor with Shanghai Normal University.

Criminal Judgment

(2021) Liao 0191 First Instance No. 250

The public prosecution agency was the People's Procuratorate of the Shenyang Economic and Technological Development Zone.

Defendant Sun Zhiming (pseudonym Sun Daluo), male, born [INTENTIONALLY OMITTED], 1957, Identification No. [INTENTIONALLY OMITTED], Han ethnicity, high school education, unemployed, household registration [INTENTIONALLY OMITTED], Tiedong District, Anshan City, Liaoning, currently residing at [INTENTIONALLY OMITTED], Lishan District, Anshan City, Liaoning. On June 23, 2021, he was taken into criminal detention in connection with this case by the Economic and Technological Development Zone Precinct of the Public Security Bureau of Shenyang. On July 31 of the same year the Economic and Technological Development Zone Precinct of the Public Security Bureau of Shenyang carried out an arrest. He is currently being held in detention at the Shenyang No. 1 Detention Center.

Defense counsel Yang Jianming is a lawyer from Liaoning Ancheng Law Firm.

In the Shen Kai Procuratorate Criminal Indictment (2021) No. Z241 indictment the People's Procuratorate of the Shenyang Economic and Technological Development Zone charged that defendant Sun Zhiming committed the crime of disturbing the peace, and on November 1, 2021 filed a public prosecution with this Court. This Court formed a collegial panel in accordance with the law and tried this case with hearings in open court. The People's Procuratorate of the Shenyang Economic and Technological Development Zone assigned Procurator Yi Xingliang and Deputy Procurator Zhao Meng to appear in court in support of the prosecution. Defendant Sun Zhiming and his defense counsel Yang Jianming appeared in court to participate in the proceedings. The trial has now concluded.

It was ascertained at trial that between 1998 and 2015 defendant Sun Zhiming wrote "A History of the Political Machinations of Mao Zedong" and "A History of the Political Machinations of Xi Jinping," and these books fabricated facts about real names. Defendant Sun Zhiming contacted foreign publishing houses in Hong Kong, Taiwan, etc. and published them. It was determined that the aforementioned two books contained content prohibited under the provisions of the "Regulations on the Administration of Publishing,” and are banned publications.

Since 2017, defendant Sun Zhiming repeatedly distributed articles and videos which were viewed many times containing fake information and adverse statements relating to politics, such as "The Cruelty of the CCP's Power Struggle," "Xi Jinping Enters the Underground Command Post to Prepare for Nuclear War," and "Mao Zedong Set a Trap to Murder Lin Biao" on foreign websites "Beijing Spring," "Bannedbook.org" and the foreign magazines "Outpost" and "Epoch Times.”

Defendant Sun Zhiming circulated the aforementioned books and magazines containing his articles to many of his friends and relatives in Beijing and Anshan, Liaoning. He also sent links, articles, and pictures containing fake information relating to politics and adverse statements relating to politics to the WeChat group “One Family (Two Coasts)” and many WeChat and QQ friends through the Internet, disrupting social order.

The aforementioned facts were proven by the following evidence submitted by the public prosecution agency and examined in court:

1.

(1) The Permanent Population Basic Information forms, Employee Registration forms, telephone inquiry records, etc., proved: Defendant Sun Zhiming had reached the age of criminal responsibility and has the capacity to bear full criminal responsibility, his work history, and that defendant Sun Zhiming had no criminal record.
(2) The Case Source and Apprehension Process proved: The circumstances of the case and the fact that defendant Sun Zhiming was arrested by the public security agency on June 23, 2021 at No. 5-6, Building 3, Lishan Jinyuan Community, Lishan District, Anshan City, Liaoning.
(3) The Jurisdiction Designated Decision proved: The Public Security Bureau of Liaoning designated the Public Security Bureau of Shenyang to have jurisdiction over this case. The Public Security Bureau of Shenyang designated the Development Zone Precinct to have jurisdiction over this case. The People's Procuratorate of Liaoning designated the People's Procuratorate of the Shenyang Economic and Technological Development Zone to have jurisdiction over this case.
(4) WeChat group and WeChat chat screenshots proved: The WeChat group named One Family (Two Coasts) had 14 people. Sun Daluo repeatedly sent fake information as well as adverse statements relating to politics containing fabricated content about China's politics, regime, and leaders to these WeChat groups. Sun Daluo repeatedly sent fake information as well as adverse statements relating to politics containing fabricated content about China's politics, regime, and leaders to Liu Fei, Fang Lihao, Wang Hui, Xu Shouwen, and others through WeChat.
(5) The list of Sun Zhiming's articles on Beijing Spring's website proved: From 2017 to 2021, defendant Sun Zhiming distributed 71 articles under the pseudonym Sun Daluo relating to politics on Beijing Spring's website, including "The Cruelty of the CCP's Power Struggle."
(6) Articles distributed by Sun Daluo on Bannedbook.org proved: Sun Daluo distributed 18 articles on Bannedbook.org, including "How to get rid of Xi Jinping" and "350,000 PLA Troops Attack Taiwan" and other reactionary political rumors.
(7) The cross-straits express parcel postal bill and the New Era magazine proved: The recipient was Sun Daluo, the address was 167 Shengli North Road, Anshan City, Liaoning, Lishan Jinyuan, Attn: Sun Daluo, the phone number was [INTENTIONALLY OMITTED]; the New Era magazine contained articles written by Sun Daluo titled "Xi Pre-Deploys Wang Xiaohong to Take Charge of Public Security and Justice" and "China Has Politics and Elders, But No Political Elders."
(8) The covers and contents of the book "A History of the Political Machinations of Xi Jinping," the manuscripts of "Xi Jinping's Spiritual Personnel History," "How Could Xi Jinping Not Choose a Successor?," "The Americans Finally Made Their Debut And Called On Li Keqiang And Wang Yang To Overthrow Xi Jinping," "The CCP County Party Secretary's Report On The Corruption Of The Previous Secretary Fell On Deaf Ears," "The Cruelty of the CCP's Power Struggle," "A History of the Political Machinations of Xi Jinping," "A History of the Political Machinations of Mao Zedong," "When Western Philosophy Suppresses Chinese Thought," and “The Truth and Reasons for the Failed Battles of the War of Resistance Against Japanese Aggression" proved: Defendant Sun Zhiming used the pseudonym Sun Daluo to distribute many articles and books containing fabricated content about China's politics, regime, and leaders.
(9) The Xiafei International Publishing Company Contract and Copyright Agreement proved: On September 19, 2008, Sun Zhiming signed a copyright agreement with Hong Kong Xiafei Publishing Co., Ltd., "A History of the Political Machinations of Mao Zedong" was published by Xiafei Publishing Co., Ltd., and 90% of the profits belonged to Sun Daluo. On June 9, 2015, Sun Zhiming signed a contract with Hong Kong Xiafei Publishing Co., Ltd., stipulating that Sun Zhiming would provide the manuscript of "A History of the Political Machinations of Xi Jinping," Xiafei would pay Sun Zhiming HK$30,000, and give Sun Zhiming 20 copies of the book.
(10) The search warrant, Seizure Decision, List of Seized Items, etc. proved: The public security agencies searched Sun Zhiming's house located at Room 506, Building 3, No. 121, Lishanjinyuan, Lishan District, Anshan City, Liaoning, and seized his mobile phone, USB flash drive, manuscripts, books, CDs and other items. [REDACTED IN ORIGINAL] "A History of the Political Machinations of Mao Zedong,” "A History of the Political Machinations of Xi Jinping,” ”When Western Philosophy Suppresses Chinese Thought," [REDACTED IN ORIGINAL].

(1) Witness Cao Dai, the owner of the WeChat group "One Family (Two Coasts)" proved: The WeChat group "One Family (Two Coasts)" had 14 members including Wang Hui, Sun Zhiming, Zhang Yan, etc. It was established in 2017. Sun Zhiming repeatedly posted articles signed by Sun Da in the WeChat group that were hostile to the State and and the government, and that opposed State policies, and made irresponsible comments about government officials, as well as images of articles distributed in "Outpost" magazine. He sent Cao Dai many articles opposing State policies and making irresponsible comments about government officials through WeChat.
(2) Witness Zheng Rongcheng proved: The WeChat group "One Family (Two Coasts)" then had 14 members. Sun Zhiming repeatedly posted sensationalist and eye-catching articles, pictures, and links to Zheng Rongcheng in the WeChat group and to Zheng Rongcheng personally.
(3) Witness Wang Hui proved: The WeChat group "One Family (Two Coasts)" had 14 people including Wang Hui, Sun Zhiming, Zhang Yan, etc. Sun Zhiming promoted his own books in the WeChat group and sent some made-up rumors to Wang Hui through WeChat.
(4) Testimony of witness Liu Yanzhi proved: The fact that the WeChat group of “One Family (Two Coasts)” had 14 members.
(5)Testimony of witness Liu Cuiping proved: The WeChat group “One Family (Two Coasts)” had more than 10 members.
(6) Testimony of witness Wang Wenbin proved: Sun Zhiming gave Wang Wenbin two books at a literary gathering, one was "A History of the Political Machinations of Mao Zedong" and the other was "The Anti-Japanese War.”
(7) Testimony of witness Mi Yimin proved: Sun Zhiming presented Mi Yimin with a book he wrote, and sent negative articles to Mi Yimin through WeChat that fabricated fake information about leaders.
(8) Testimony of witness Yang Deyi proved: Sun Zhiming circulated his books "A History of the Political Machinations of Mao Zedong" and "A History of the Political Machinations of Xi Jinping" to everyone at a literary gathering, and sent fabricated fake information and negative articles written by him on Bannedbook.org and "Outpost" magazine to Yang Deyi through WeChat to smear China.
(9) Testimony of witness Su Shengwei proved: Sun Zhiming circulated his "A History of the Political Machinations of Mao Zedong" and "A History of the Political Machinations of Xi Jinping" to everyone at a literary gathering, and sent text documents containing concocted facts and denigrating China and leaders to Su Shengwei via WeChat.
(10) Testimony of witness Xu Chaoyang proved: Xu Chaoyang and Sun Zhiming were QQ friends. When Xu Chaoyang browsed "Bannedbook.org" by climbing-the-wall, he saw Sun Daluo's article on Xi Jinping's political history, and then exchanged his thoughts with Sun Zhiming.
(11) Testimony of witness Sun Zhigang proved: Sun Zhiming had shown him Sun Zhiming's "A History of the Political Machinations of Mao Zedong" and "The Truth and Causes of the Failed Battles in the Anti-Japanese War" in person, and had sent Sun Zhigang an article written by Sun Zhiming in the "Outpost" magazine about Tianjin Party Secretary Li Hongzhong through WeChat. Sun Zhigang believed that what Sun Zhiming wrote was entirely made-up and without basis.
(12) Testimony of witness Sun Dong proved: Sun Zhiming sent photos and a brief introduction of Xi Jinping's political history and some negative current events to Sun Dong via WeChat, and Sun Dong forwarded them to his WeChat friends.
(13) Testimony of witness Fang Lihao proved: Sun Zhiming showed Fang Lihao the manuscript of his book "When Western Philosophy Suppresses Chinese Thought" before it was published, and the manuscript of his book "A History of the Political Machinations of Xi Jinping" after it was published, and sent Fang Lihao articles signed by Sun Zhiming on the promotion of senior Chinese leaders, personnel changes, and personnel analysis via WeChat.
(14) Testimony of witness Xu Shouwen proved: Sun Zhiming had sent Xu Shouwen an article containing fake information and denigrating China’s leaders via WeChat.
(15) Testimony of witness Zhang Man proved: Sun Zhiming once let Zhang Man read the books he had written;
(16) Testimony of witness Wang Liyan, wife of Sun Zhiming proved: Sun Zhiming had taken Wang Liyan to travel to Hong Kong and Taiwan.

3. Defendant Sun Zhiming’s statements proved: Defendant Sun Zhiming used a fictitious writing style to write "A History of the Political Machinations of Mao Zedong" and "A History of the Political Machinations of Xi Jinping," which were published by foreign publishing houses. He also distributed books and articles on foreign websites many times that were unfounded, concocting fake information and vilifying China and State leaders, and also spread the contents of the above books and articles to others through the Internet and other channels.

4. The Press and Publication Bureau of Liaoning’s Forensic Opinion on the two books "A History of the Political Machinations of Mao Zedong" and "A History of the Political Machinations of Xi Jinping," proved: After reviewing the two publications, the forensic personnel determined that "A History of the Political Machinations of Mao Zedong" and "A History of the Political Machinations of Xi Jinping" contained contents prohibited as provided in Articles 25 and 45 of the "Regulations on the Administration of Publishing,” and were banned publications.

5. Electronic evidence examination records proved: The public security agencies collected Sun Zhiming's QQ account number 19648988, nicknamed Bobo (UFO), QQ account number 496704871, nicknamed Sun Dasheng, three WeChat accounts with the WeChat nicknames Sun Daluo, Sun Daluo, and Qitian Dasheng, and two QQ email addresses with the nicknames Qitian Dasheng and Sun Beijing;

6. Audio-visual materials and electronic data proved: The public security agencies extracted the content of Sun Zhiming's mobile QQ number and WeChat account. After inspection, the QQ number nicknamed Sun Dasheng had sent a photo of the author of Xi Jinping's history of power politics to his friends Little Woman and Big Heart on June 17, 2020. On August 31, 2020, he chatted with his friend Air and sent pictures of the covers and author profile pages of three books he had distributed. On April 8, 2020, he chatted with his friend Nian Nian Zhi Gui about a book written by Sun Zhiming. On June 22, 2021, a WeChat account with the nickname Monkey King sent a message to his WeChat friend Tian Shen, saying that China no longer has any secrets to keep and the CCP is doomed. On September 29, 2019, he sent a message to his WeChat friend Xianyunyehe, forwarding Qin Kejiang’s chat history (the content was about Wang Lijun’s death, and included comments on Bo Xilai and Wang Lijun). On September 16, 2019, a WeChat account with the nickname Sun Daluo sent a Word document titled Reflections on June 4th from a Strategic Perspective (1) to his WeChat friend Zhan Duizhang. The document commented on the reasons why the June 4th movement failed, the eternal spirit of June 4th, and the stupidity of the form June 4th took.On September 23, 2019, he sent a Word document titled "The Trial of Mao Zedong is Not Over Yet" by biographer Ye Yonglie to his WeChat friends War Captain. On October 9, 2019, he sent a file to WeChat friend Dong Zhaoxuan, saying that Xi Jinping's military parade may burn 15 billion yuan to boost funds, which would have serious consequences. The "1004.txt" on the Aboluowang News Network on October 3, 2019 contained multiple commentary articles on the military parade. On October 9, 2019, he sent a file named 1004.txt to his WeChat friends FBA, Thinking Reed, Cao, and Liu Shangjun. The content was the same as above. On September 23, 2019, he sent a text to WeChat friend Sun Xiaobo about how to retrieve the content of Sun Daluo’s Beijing Spring article on how Li Peng became prime minister. On September 27, 2019, he sent a file named "hrd.txt" to his WeChat friends Shenzhen Gaosheng, Xu Shouwen, and Liu Fei. The content of the file was about the death of Ye Xuanning and Ye Xuanping, two members of the second generation of the Red Army, and the decline of Ye Jianying's family. On September 23, 2019, he sent a Word document titled "The Trial of Mao Zedong is Not Over Yet" to his WeChat friend Liu Fei. On September 24, 2019, he sent a file named "i(2).pdf" to Liu Fei. The file contained a 254-page book titled “Mao Zedong’s Collaboration with the Japanese Army.” The WeChat account nicknamed "The Monkey King" contained articles relating to politics, such as Xi Jinping's history of political power, the struggle between Mao's rule and the Party's rule, Mao Zedong's little-known stories, Zhou Enlai in his later years, and the bloody battle of Songhu.

The aforementioned facts have been confirmed by the following evidence presented and examined in court, and are sufficient to make a determination.

This Court finds defendant Sun Zhiming authored prohibited publications, fabricated fake information, and while clearly knowing it was fabricated fake information, nevertheless used network transmission and other means to disseminate fake information, undermining social order, creating an adverse social influence. His actions constitute the crime of disturbing the peace. The public prosecution agency’s charges are established, and are supported by this Court. In light of the fact that defendant Sun Zhiming showed a relatively good penitent attitude, and in addition this is his first offense, therefore this case can be tried applying confession of guilt and acceptance of punishment and a show of leniency. Taking these into consideration in sentencing, defense counsel’s opinion that he be given a lighter punishment is adopted by, this Court. In summary, in accordance with the provisions of Articles 293, 67(3), and 64 of the “Criminal Law of the People’s Republic of China” and Article 4 of the “Interpretation Regarding Certain Questions About the Specific Laws to be Used in Adjudicating Criminal Cases of Illegal Publications,” the judgment is as follows:

1. Defendant Sun Zhiming committed the crime of disturbing the peace and is sentenced a fixed term imprisonment of one year (The prison term is to be calculated starting on the day the judgment is executed, and each day in custody prior to the execution of the judgment shall count as one day of the prison term, that is from June 23, 2021 to June 22, 2022).

2. The seized paper notebooks, 7 books, 2 CDs, 1 book, 5 mobile phones, 2 USB flash drives, and 4 photos shall be confiscated in accordance with the law.

If any party does not accept this judgment, they may within 10 days after the second day after receiving this written judgment bring an appeal through this Court or directly to the Intermediate People's Court of Shenyang, Liaoning. A written appeal should be submitted with one original and one copy of the appeal brief.

公诉机关沈阳经济技术开发区人民检察院。

被告人孙志明(笔名孙大骆),男,1957年[INTENTIONALLY OMITTED]出生,身份证号码[INTENTIONALLY OMITTED],汉族,高中文化,无业,户籍地辽宁省鞍山市铁东区[INTENTIONALLY OMITTED]7,现住辽宁省鞍山市立山区[INTENTIONALLY OMITTED]。因本案于2021年6月23日被沈阳市公安局经济技术开发区分局刑事拘留;同年7月31日被沈阳市公安局经济技术开发区分局执行逮捕。现羁押于沈阳市第一看守所。

辩护人杨建明,辽宁安成律师事务所律师。

沈阳经济技术开发区人民检察院以沈开检公诉刑诉(2021)Z241号起诉书指控被告人孙志明犯寻衅滋事罪,于2021年11月1日向本院提起公诉。本院依法组成合议庭,公开开庭审理了本案。沈阳经济技术开发区人民检察院指派检察官伊兴良、检察官助理赵梦出庭支持公诉。被告人孙志明及其辩护人杨建明到庭参加诉讼。现已审理终结。

经审理查明,被告人孙志明于1998年至2015年期间,撰写了《毛泽东权术史》、《习近平权术史》,该书记载真实姓名方式虚构事实。被告人孙志明与香港、台湾等境外出版机构联系并出版。经认定,上述2种图书含有《出版管理条例》规定的禁止性内容,系违禁出版物。

自2017年以来,被告人孙志明在境外网站“北京之春”、“禁书网”和境外杂志《前哨》、《新纪元》上多次发表《中共权力斗争残酷表》、《习近平进入地下指挥所准备核战争》、《毛泽东下套谋杀了林彪》等多篇含有虚假涉政信息、负面涉政言论等内容的文章及视频,被多人次浏览。

被告人孙志明分别在北京市、辽宁省鞍山市向其多名朋友、亲属传阅其出版的上述书籍和含有其发表文章的杂志。并通过网络向微信群“一家亲(两岸)”,多名微信好友、QQ好友多次发送含有虚假涉政信息、负面涉政言论的链接、文章、图片,破坏社会秩序。

 上述事实,有公诉机关提交并经法庭质证的下列证据予以证明:

1.

(1)常住人口基本信息表、职工登记表等、电话查询记录,证明被告人孙志明已达刑事责任年龄,具备完全刑事责任能力,及其工作履历情况,被告人孙志明无前科劣迹;

(2)案件来源、抓捕经过,证明本案案发情况,及被告人孙志明于2021年6月23日在辽宁省鞍山市立山区丽山锦苑小区3号楼5-6号被公安机关抓获的事实;

(3)指定管辖决定书,证明本案系辽宁省公安厅指定沈阳市公安局管辖,沈阳市公安局指定开发区分局管辖;辽宁省人民检察院指定沈阳经济技术开发区人民检察院管辖;

(4)微信群、微信聊天截图,证明群名为一家亲(两岸)的微信群共有14人,孙大骆曾多次向该微信群发送含有捏造中国政治、政权、领导人内容的虚假信息及负面涉政言论。孙大骆曾通过微信多次向刘飞、房黎浩、旺辉、许守文、发送含有捏造中国政治、政权、领导人内容的虚假信息及负面涉政言论;

(5)北京之春网站上孙志明发表文章列表,证明2017年至2021年间,被告人孙志明以孙大骆的笔名在北京之春网站上发表含《中共权力斗争残酷表》等涉政文章71篇;

(6)禁书网网站上孙大骆发表文章列表,证明孙大骆在禁书网网站上发表过18篇含《怎么搞掉习近平》、《共军35万大军攻打台湾》等反动政治谣言;

(7)邮政两岸小包快递单、新纪元杂志,证明收件人为孙大骆,地址为辽宁省鞍山市胜利北路167号丽山锦苑物业转孙大骆,电话[INTENTIONALLY OMITTED];新纪元杂志中作者为孙大骆的名为《习预先部署王小洪待掌公安政法》、《中国有政治有老人却没有政治老人》的文章;

(8)《习近平权术史》书籍、《习近平精神人事史》手稿、《习近平怎么可能不选接班人呢》、《美国人终于粉墨登场号召李克强汪洋推翻习近平》、《中共县委书记举报前任书记腐败石沉大海》、《中共权力斗争残酷表》、《习近平权术史》、《毛泽东权术史》、《当西方哲学压向中国思想》、《抗日战争历次失败战役的真相及其原因》书籍封面及内容,证明被告人孙志明使用孙大骆笔名,发表多篇含有捏造虚假中国政治、政权、领导人内容的文章及书籍;

(9)夏菲尔国际出版公司合同、版权协议书,证明2008年9月19日,孙志明与香港夏菲尔出版有限公司签订版权协议书,《毛泽东权术史》由夏菲尔出版有限公司出版,90%收益归孙大骆所有。2015年6月9日,孙志明与香港夏菲尔出版有限公司签订合同,约定由孙志明提供《习近平权术史》书稿,夏菲尔公司支付孙志明港币3万元,并给孙志明书籍20本;

(1)证人曹岱,系“一家亲(两岸)”的微信群群主,证明“一家亲(两岸)”的微信群共有王辉、孙志明、张艳等14人,建于2017年,孙志明多次在该微信群中发送署名为孙大的敌对国家、政府,反对国家政策、妄议政府官员的文章,及其在《前哨》杂志上发表文章的图片。通过微信向曹岱发送过多篇反对国家政策,妄加议论政府官员的文章;

(2)证人郑荣城,证明“一家亲(两岸)”的微信群现在共有14人,孙志明多次在该微信群中及向郑荣城个人发送标题党,搏人眼球的文章、图片、链接;

(3)证人王辉,证明“一家亲(两岸)”的微信群共有王辉、孙志明、张艳等14人,孙志明在该微信群推销自己撰写的书籍,并通过微信向王辉发送一些无中生有的谣言;

(4)证人刘艳枝的证言,证明“一家亲(两岸)”的微信群共有14人的事实;

(5)证人刘翠萍的证言,证明“一家亲(两岸)”的微信群共有10几人的事实;

(6)证人王文斌的证言,证明孙志明在文友聚会上送给王文斌两本书一本是《毛泽东权术史》,一本是《抗日战争》;

(7)证人一民的证言,证明孙志明向米一民赠送其写的书,并通过微信向米一民发送编造领导人虚假信息的负面文章;

(8)证人杨德义,证明孙志明在文友聚会上向大家传阅其写的《毛泽东权术史》、《习近平权术史》,并通过微信向杨德义发送其在禁书网、《前哨》杂志上写的捏造虚假信息,抹黑中国的负面文章;

(9)证人苏胜伟的证言,证明孙志明在文友聚会上向大家传阅其写的《毛泽东权术史》、《习近平权术史》,并通过微信向苏胜伟发送含有捏造事实,诋毁中国及领导人的文本文档;

(10)证人徐朝阳的证言,证明徐朝阳与孙志明系QQ好友,徐朝阳翻墙浏览“禁书网”时看到过孙大骆习近平权术史的文章,后与孙志明交流心得:

(11)证人孙志钢的证言,证明孙志明曾当面给孙志钢看其写的《毛泽东权术史》、《抗日战争历次失败战役的真相及其原因》,通过手机微信向孙志钢发送过一篇孙志明在《前哨》杂志上写的关于天津市委书记李鸿忠的文章,孙志钢认为孙志明写的都是没有根据的胡编乱造;

(12)证人孙东的证言,证明孙志明通过微信向孙东发送习近平权术史的照片及简介和一些负面的时事,孙东向自己的微信好友转发过的事实;

(13)证人房黎浩的证言,证明孙志明给房黎浩看过其写的《当西方哲学压向中国思想》出版前的手稿,和出版后的《习近平权术史》,并通过微信向房黎浩发送孙志明署名的内容为中国高层领导人升迁、人事变动、人事分析的文章;

(14)证人许守文的证言,证明孙志明曾通过微信向许守文发送含有捏造虚假信息,诋毁中国领导人的文章;

(15)证人张曼的证言,证明孙志明曾让张曼看其写过的书;

(16)证人王立艳,系孙志明妻子,证明孙志明曾带王立艳到过香港、台湾旅游;

3.被告人孙志明的供述,证明被告人孙志明采用虚构事实的写作方式撰写《毛泽东权术史》、《习近平权术史》,在境外出版机构出版,并多次在境外网站发表无事实根据,捏造虚假信息,污蔑中国及国家领导人的书籍和文章,还将上述书籍、文章等内容通过网络等途径向他人传播的事实;

4.辽宁省新闻出版局关于对《毛泽东权术史》等2种图书的鉴定意见,证明经鉴定人员对《毛泽东权术史》、《习近平权术史》等2种出版物进行审读,认定《毛泽东权术史》、《习近平权术史》2种图书含有《出版管理条例》第二十五条、第四十五条规定的禁止性内容,系违禁出版物;

5.电子证据检查笔录,证明公安机关对孙志明QQ账号为19648988,昵称为波波(UFO)、QQ账号为496704871,昵称为孙大圣的账号,微信昵称为孙大骆、孙大骆、齐天大圣的三个微信号,两个昵称为齐天大圣、孙北京的QQ电子邮箱进行提取;

6.视听资料、电子数据,证明公安机关通过对孙志明的手机QQ号、微信号内容进行提取。经检查,昵称为孙大圣的QQ号于2020年6月17日向好友小女人,大胸怀发送一张习近平权术史作者简述的照片;于2020年8月31日与好友air聊天并发送其发表的三本书封面及作者简介页图片;于2020年4月8日与好友念念知归聊天关于孙志明写的书的讨论。昵称为齐天大圣的微信号于2021年6月22日向微信好友田申发送信息,内含中国已无秘可保,中共的命数已尽等;于2019年9月29日向微信好友闲云野鹤发送信息,转发秦克江的聊天记录(内容王立军之死,含有评论薄熙来、王立军之事的内容)。昵称为孙大骆的微信号于2019年9月16日向微信好友戰隊長发送名为从战略角度反思六四(1)的Word文件,内容为评论六四运动失败的原因,六四的精神永存,六四的形式愚蠢;于2019年9月23日向微信好友戰隊長发送名为对毛泽东的审判还没有结束的Word文件,传记作家叶永烈;于2019年10月9日向为微信好友董兆轩发送文件内容为习近平大阅兵或狂烧150亿给资金打气后果很严重。阿波罗新闻网2019年10月3日讯的“1004.txt”,内含多篇关于大阅兵的评论文章;于2019年10月9日向微信好友FBA、会思考的芦苇、曹、柳尚君发送名为1004.txt的文件,内容与前面一样;2019年9月23日向微信好友孙小波发送一段文字,北京之春孙大骆文章检索李鹏是如何当上总理的及文章内容;于2019年9月27日向微信好友深圳高生、许守文、刘飞发送名为“hrd.txt”的文件,文件内容为红二代独服叶选宁叶选平去世与叶剑英家族凋零;于2019年9月23日向微信好友刘飞发送名为对毛泽东的审判还没有结束的Word文件;于2019年9月24日向刘飞发送名为“i(2).pdf”的文件,文件内容为一本名为毛泽东勾结日军的书籍,共254页。昵称为齐天大圣的微信号中收藏了习近平权术史的手稿、毛天下与党天下之争、毛泽东鲜为人知的故事,晚年周恩来、淞沪大血战等涉政文章;

以上证据,经庭审质证,查证属实,足以认定。

本院认为,被告人孙志明撰写违禁刊物,编造虚假信息,且明知是编造的虚假信息,仍通过网络传播等方式散布虚假信息,破坏社会秩序,造成恶劣社会影响,其行为已构成寻衅滋事罪。公诉机关指控罪名成立,本院予以支持。鉴于被告人孙志明认罪态度较好,且系初犯,以及本案适用认罪认罚从宽制度审理,量刑时均予以考虑。对辩护人提出的从轻处罚的意见,本院予以采纳。综上,依照《中华人民共和国刑法》第二百九十三条、第六十七条三款、第六十四条、《关于办理寻衅滋事刑事案件适用法律若干问题的解释》第四条的规定,判决如下:

一、被告人孙志明犯寻衅滋事罪,判处有期徒刑一年;(刑期从判决执行之日起计算。判决执行以前先行羁押的,羁押一日折抵刑期一日,即自2021年6月23日起至2022年6月22日止。)

二、扣押之纸质笔记本7本,光盘2张,书籍1本,手机5部,U盘2个,照片4张,依法予以没收。

如不服本判决,可在接到判决书的第二日起十日内,通过本院或者直接向辽宁省沈阳市中级人民法院提出上诉。书面上诉的,应当提交上诉状正本一份,副本一份。

Party Investigates Another Person Citing He Read Books with "Political Problems"

As noted previously on this blog, the PRC Communist Party considers reading books with "political problems" to be grounds to punish government officials. Now the Party is citing the same justification in a decision to punish a businessman. According to PRC state-sponsored media, Tang Shuangning (唐双宁), former Party chief and chairman of the China Everbright Group was being investigated by the Communist Party of China Central Commission for Discipline Inspection and the National Commission of Supervision for corruption. The official government/Party statement (machine translated below) cited several grounds supporting their claims that he had committed violations of "Party discipline and law," including:

  • Weakening the Party's leadership over state-owned enterprises (弱化党对国有企业的领导);
  • Bringing books and periodicals with serious political problems into the country without permission and reading them (私自携带有严重政治问题的书刊入境并阅看).

Tang Shuangning, former Party Secretary and Chairman of China Everbright Group, was expelled from the Party for serious violations of discipline and law.

According to the website of the Central Commission for Discipline Inspection and the National Supervisory Commission, with the approval of the Central Committee of the Communist Party of China, the Central Commission for Discipline Inspection and the National Supervisory Commission launched a case review and investigation into Tang Shuangning, the former Party Secretary and Chairman of China Everbright Group Co., Ltd., for serious violations of discipline and law.

After investigation, Tang Shuangning lost his party spirit, abandoned his duties and missions, was not resolute in implementing the Party Central Committee's major decisions and arrangements, weakened the Party's leadership over state-owned enterprises, failed to prevent and resolve financial risks, violated the Party's organizational line, and abandoned the principle of comprehensive and strict governance of the Party. He took advantage of his authority to publicize personal calligraphy and other works, brought books and periodicals with serious political issues into the country without permission and read them, resisting organizational scrutiny. Ignoring the spirit of the eight central regulations, he used public funds to travel abroad in disguise in the name of inspection, and approved the purchase of buildings and halls in violation of regulations. He violated organizational principles and sought benefits for others in the selection and appointment of cadres. He lost his integrity, condoned and acquiesced in allowing others to use his authority for personal gain, and illegally accepted gifts and money such as celebrity calligraphy and paintings, commemorative coins, etc. He was greedy for pleasure, accepting "housekeeper-style" service. He wanted to be an official and be famous at the same time, transforming the public power granted by the Party and the people into a tool for seeking fame and fortune, engaging in "elegant corruption", taking advantage of the convenience of his position, illegally occupying public property, providing loans for others seeking profits from approvals, job promotions, etc., and illegally receiving huge amounts of property.

Tang Shuangning seriously violated the Party's political discipline, organizational discipline, integrity discipline and life discipline, which constituted a serious job violation and was suspected of corruption and bribery crimes. He also refused to restrain or stop after the 18th National Congress of the Party. The nature was serious and the impact was bad, so he should be punished. In accordance with the "Disciplinary Punishment Regulations of the Communist Party of China", the Supervision Law of the People's Republic of China, the Law of the People's Republic of China on Administrative Punishments for Public Servants, and other relevant provisions, after study by the Standing Committee of the Central Commission for Discipline Inspection at a meeting and reported to the Central Committee of the Communist Party of China for approval, it was decided to expel Tang Shuangning from the Party. It stipulated that the treatment he enjoys will be cancelled; his illegal gains that violate discipline and laws will be confiscated; his suspected criminal issues will be transferred to the procuratorate for review and prosecution in accordance with the law, and the property involved will be transferred together.

唐双宁严重违反党的政治纪律、组织纪律、廉洁纪律和生活纪律,构成严重职务违法并涉嫌贪污、受贿犯罪,且在党的十八大后不收敛、不收手,性质严重,影响恶劣,应予严肃处理。依据《中国共产党纪律处分条例》《中华人民共和国监察法》《中华人民共和国公职人员政务处分法》等有关规定,经中央纪委常委会会议研究并报中共中央批准,决定给予唐双宁开除党籍处分;按规定取消其享受的待遇;收缴其违纪违法所得;将其涉嫌犯罪问题移送检察机关依法审查起诉,所涉财物一并移送。

Party Expels Official Citing He Read Books with "Political Problems"

The following is a translation of a notice posted on the website of the Beijing Municipal Commission for Discipline Inspection and Beijing Municipal Supervision Commission.

With the approval of the Beijing Party Committee, the Beijing Commission for Discipline Inspection and Supervision decided to expel Zhang Guilin (at the bureau level), the former director of the State-owned Assets Supervision and Administration Commission of the Beijing People's Government, as a sanction of expulsion from the Party and dismissal from public office.

An investigation found that Zhang Guilin's political awareness was weak, and he kept hidden caches of, and read, books and periodicals with serious political problems. He violated the spirit of the eight central regulations by accepting gifts of money and gift cards that might affect the fair execution of his official duties. He did not truthfully report personal matters. He engaged in sexual transactions. He interfered and meddled in government procurement projects. H took advantage of his position to seek benefits for others, and illegally accepted other people's property.

Zhang Guilin seriously violated the Party's political discipline, organizational discipline, integrity discipline, work discipline, and life discipline, which constituted a serious breach of duty. He was also suspected of accepting bribes. He failed to cease and desist in this conduct following the 18th National Congress of the Communist Party of China. The nature was severe and the impact was malicious. It should be dealt with seriously. In accordance with relevant regulations such as the Regulations on Disciplinary Sanctions of the Communist Party of China, the Supervision Law of the People's Republic of China, and the Law of the People's Republic of China on Governmental Sanctions for Public Officials, after studying at the meeting of the Standing Committee of the Municipal Commission for Discipline Inspection and reporting to the Municipal Party Committee for approval, It was decided Zhang Guilin should be expelled from the Party and dismissed from public office. His illegal gains shall be confiscated, and the case of his suspected crimes has been transferred to the procuratorate for review and prosecution in accordance with the law, and transfer the property involved. Baidu and Sina Censor Information About Yanhuang Chunqiu Magazine and Former Editor Du Daozheng

These screenshots were taken on July 15, 2016, and show that Baidu was restricting search results for “炎黄春秋” (Yanhuang Chunqiu, lit. (“The Spring and Autumn Annals of the Emperors Yan and Huang”)) to websites operated by the central government and Communist Party (and Baidu's own Wikipedia clone).


This screenshot was also taken on July 15, 2016, and shows that when a user searches for "Yanhuang Chunqiu" on Sina Weibo they are told that "In accordance with relevant laws, regulations, and policies, search results for ''Yanhuang Chunqiu' have not been displayed."


On July 17, 2016, the state-sponsored Global Times published an article entitled “Liberal Journal Opposes Editorial Board Shake-up.” Some excerpts:
The editorial board of Yanhuang Chunqiu, a liberal monthly journal known for bold discussions on politics and history, was recently reshuffled by The Chinese National Academy of Arts.

The academy, with which the journal is affiliated, published a notice on July 12 and declared that the academy’s leadership decided to replace or demote the editorial leadership, including its president, editor-in-chief, vice-presidents and deputy editors. According to the notice, the academy appointed a new management team for the journal led by Jia Leilei, the academy’s vice-president, who replaced Du Daozheng as the president of Yanhuang Chunqiu.

The journal said its editorial board has enlisted the services of a lawyer and intends to sue the academy, RTHK reported.

The magazine was founded in 1991 and has been known for publishing outspoken articles, often involving topics such as constitutionalism and the Cultural Revolution. It has received the backing of many retired senior officials.

An unconfirmed statement allegedly issued by Du is spreading online has voiced strong opposition to the decision from the Chinese National Academy of Arts. The statement claims that Du and his colleagues are trying to defend their magazine and their “outspoken” style from the shake-up. It also said they are preparing for the closure of Yanhuang Chunqiu, Taipei-based Central News Agency (CAN) reported.

The statement read:
On July 12, the Chinese National Academy of Arts illegally and unilaterally ripped to shreds the "Written Agreement Between the Chinese National Academy of Arts and Yanhuang Chunqiu Magazine Publishing" it had signed with "Yanhuang Chunqiu," announced a reshuffle of our publisher's leadership structure,  severely infringed upon the freedom of the press granted to citizens by Article 35 of the Constitution, and violated the right of our publisher to hiring, editorial, financial independence that was clearly agreed upon in Written Agreement.

On July 15, the Chinese National Academy of Arts dispatched officials to the publisher and stole and altered the passwords of the official website of "Yanhuang Chunqiu," leading to our magazine losing the basic conditions necessary for editing and publishing.

In light of this, and following discussion among, and a unanimous decision by, the publishing committee of Yanghuang Chunqiu Magazine Publishing, publishing shall cease as of today. Henceforth anyone distributing a publication under the title "Yanhuang Chunqiu" shall not bear any relationship with this publisher.

Chronicling Local Government Tactics Targeting "Politically Harmful" Hong Kong Publications and Their Distributors

The following are excerpts of notices and regulations published on the web pages of local Chinese governments. These texts indicate that, beginning in 2012, local Chinese governments were undertaking initiatives regarding "politically harmful publications" such as:
  • Cleansing school campuses of illegal publications;
  • Using commercial, tax, and other tools to suppress Hong Kong media outlets that engage in reactionary publishing and their operators who come to mainland China to conduct economic activities;
  • Banning 14 Hong Kong and Taiwan publication distributors;
  • Banning 21 types of Hong Kong periodicals;
  • Blocking "specified persons" from returning to mainland China;
  • Prosecuting those spreading politically harmful publications using mobile apps, "Great Firewall circumvention" software, social media, and micro-blogs;
  • Preventing tourists bound for Hong Kong and Taiwan  from purchasing politically harmful publications to bring back to China;
  • Disciplining Party members who bring overseas politically harmful publications back to China.

These documents called for the purification, confiscation, banning, and blocking of politically harmful publications. In particular, the illegal publications listed in the catalogs must be banned from school campuses. In order to coordinate with the "Sweep Away Pornography and Strike Down Illegal Publications" Office's work in purifying and confiscating harmful books, the following requirements must be met:

1. After receiving the Notices all school districts and schools must immediately conduct a cleansing of the books in their school districts and school libraries, and upon discovery of any politically harmful book, resolutely move to either clear it out and seal it up, or directly destroy it.  Strictly prohibit harmful books from coming onto school campuses.

2. All school districts and schools must supervise and urge teachers and students to purify their personal book collections, and as soon as they discover any books listed in a catalog as banned or as being  from a distributor of harmful publications they must be handed over for destruction. It is strictly prohibited to collect or circulate books listed in a catalog.

3. The Department of Education will strengthen its oversight and inspections of illegal publications in order to purify school campuses, and in cases where a malicious influence is created because ban enforcement is insufficiently strict it shall hold the relevant individuals personally responsible. All school districts and schools must document the work they do to cleanse school campuses of illegal publications (on paper and electronically), and file a report with their county education bureaus before October 5.

最近,陇南市“扫黄打非”工作领导小组办公室最近连续下发了《关于下发境外“法**功”出版物查堵目录的通知》(陇扫黄打非办法[2012]11号)、 《关于下发2012年第七批政治性有害出版物查堵目录的通知》(陇扫黄打非办法[2012]12号)、《关于开展迎接党的十八大“扫黄打非”集中整治行动 的通知》(陇扫黄打非办法[2012]13号)、《关于转发<关于进一步约束内地企业对香港反动出版传媒机构经济行为的通知>的通知》(陇扫 黄打非办法[2012]14号)、《关于印发第一批香港政治性有害出版物主要传发行机构名单的通知》(陇扫黄打非办法[2012]15号)5个文件,要求 对政治性有害出版物一律进行清缴封堵。坚决禁止非法出版物特别是目录要求所列书籍进校园。为配合扫黄打非办公室清缴有害书籍工作,现将有关事宜要求如下:

一、各学区、校接到通知后要立即对本学区、校图书馆图书进行清理,一旦发现政治性有害书籍,坚决清理封存或直接销毁,严禁有害书籍进校园。

二、各学区、校要督促教师和学生要对个人收藏书籍进行清理,一经发现目录禁止出版物及有害出版物发行机构的图书,一律清缴销毁,严禁个人收藏传阅目录所列图书。

三、教育局将加强对清理校园非法出版物工作的督促检查,对查禁不力造成恶劣影响的要追究单位和相关责任人的责任。各学区、校要将清理校园非法出版物工作情况形成文字材料(纸质及电子版),于10月5日前上报县教育局基教股。

At present, profound and complex changes are taking place in both the international and domestic terrain, with struggles in the ideological realm becoming extremely pointed, failures in all attempts to put a stop to illegal publication and distribution activities, enemy forces using concocting reactionary publications and sparing no efforts to spread false ideologies and viewpoints, inciting discontent amongst the masses.

The struggle against infiltration and counter-infiltration of the publishing realm is extremely pointed, with no let up in Hong Kong acting as the base for political illegal publications to infiltrate and spread into mainland China.

Looking at our situation, even after years of strenuous work, while the problems of printing and producing political illegal publications have vanished in our city, there remains the difficult task of preventing these kinds of publications from flowing into our city. We have yet to adopt further investigative and banning measures, and we need new breakthroughs when it comes to opposing and countering them.

We will attack the venues that produce, sell, and distribute illegal publications such as those involving "Tibetan independence," Xinjiang separatism, religious extremist ideology, and violent terrorism, and bring information work within a targeted campaign.

Strengthen Integrated Opposing and Countering Work. There are two primary tasks: First, earnestly implement the list of 14 Hong Kong publication distributors "banned" by the "Sweep Away Pornography and Strike Down Illegal Publications" Office in 2012. Confiscate and block their publications and related information without exception, regardless of whether or not there is any problems with the content.

Use commercial, tax, and other tools to suppress Hong Kong media outlets that engage in reactionary publishing and their operators who come to Dongying to conduct economic activities. Impose a total ban on their social activities within the city.

With respect to certain "special persons," the Public Security Bureau should undertake coercive measures to restrict their return to mainland China.

We must endeavor to secure new breakthroughs in this work during this "Purify the Source" campaign.

The second job is to expand the ranks of information agents, and strengthen intelligence gathering on those publishers, printers, distributors, and book stores involved with politically harmful publications, as well as their primary managers and authors.

Ensure that information collected in intelligence reports is timely and accurate.

The responsible agencies will be the municipal State Security Bureau, Public Security Bureau, Customs Office, Administration of Industry and Commerce, Propaganda Bureau, and "Sweep Away Pornography and Strike Down Illegal Publications" Office.

Suzhou Municipal Government, Xiangcheng District "Cleanse the Source" Special Operations in Furtherance of Investigating, Blocking, and Countering Hong Kong's Reactionary Publishing Action Plan

In accordance with the requirements of the "Suzhou Municipal Government, Xiangcheng District 2013 'Sweep Away Pornography and Strike Down Illegal Publications' Action Plan" jointly issued by the provincial and municipal "Sweep Away Pornography and Strike Down Illegal Publications" Task Force offices, it is decided that from the end of May through the middle of October this year there will be organized a district-wide launch of a "Cleanse the Source" special operation in furtherance of investigating, blocking, and countering Hong Kong's reactionary publishing. The Plan is hereby formulated as follows:

1. Operational Objectives

On the basis of the requirements of grabbing the head and attacking the base, the main measures are to conduct ruthless border inspections, screen the mails, take charge of the printing presses, comb through the markets, take charge of the networks, impose restrictions internally, and establish an integrated system of blocks. When investigating cases the starting point should coordinated governance of both the online and the offline. Launch  a "Cleanse the Source" special operation in furtherance of investigating, blocking, and countering Hong Kong's reactionary publishing, and strive to govern through this special operation. Ensure that there are no incidents of batches of politically harmful publications entering the borders, of printing or pirating of politically harmful publications at any scale, of information pertaining to politically harmful publications being spread online, or  of major incidents or lax investigation of incidents relating to politically harmful publications.

2. Work Methodologies

(i) Strengthen Border Inspections. To strengthen border controls for politically harmful publications the focus should be on investigating and prosecuting those who carry banned publications over the border, earnestly carry out the requirements set forth in the "Notice Regarding Strictly Prohibiting Party Cadres From Publishing Politically Harmful Publications and Essays and Carrying Harmful Publications Back to China," supervise and urge travel agencies to implement measures such as briefing, guiding, and dissuading tourists.

(ii) Strengthen Postal Inspections. Strictly regulate channels fo the circulation of materials, and supervise and urge delivery services, storehouses, high speed rail operators and others in the transportation industry to establish comprehensive mechanisms for inspection and screening. In particular, it is necessary to increase the rate of inspection of postal deliveries, tourist luggage, express deliveries, and all other kinds of merchandise transport methods originating from Hong Kong. Upon discovering anything suspicious carry out a complete inspection, and perfect mechanisms for blocking channels through which illegal publications flow.

(iii) Strengthen Oversight and Control of Printing Presses. Strenuously drive forward the three foundations of administration - legal enterprises, regulated operations, and responsible management. Make effective use of the Jiangsu Province's online registration system for printing professionals, and further perfect the administration of the accounts of printers and copying businesses and related management systems. Make the focus of investigations those printing enterprises that have a record of breaking the law, being the target of complaints, engaging in overseas printing, or having the ability to print publications. It is particularly necessary to strengthen oversight and control over those printing enterprises that provide binding and other services for Hong Kong publishing activities, and resolutely ban illegal printing or copying for "dens of iniquity."

(iv) Strengthen Combing Through Markets. Step up the degree of oversight and control over markets for publications, undertake joint investigations, error checking, undercover investigations, cross-checking, and other measures. Supervise and urge markets where the sale of publications is concentrated and wholesale an retail locations to regulate the channels of importation. Strictly implement rules relating to the administration of sales. Resolutely investigate and prosecute anyone who holds political illegal publications.  Use daily patrols to maintain a state of high pressure at focal points such as downtown districts, tourist attractions, and transportation hubs. Resolutely ban those who would peddle illegal publications using mobile stalls and unlicensed business operators.

(v) Strengthen Oversight and Control Online. Strengthen fundamental management of the Internet and mobile communications. Supervise and urge telecommunication operating enterprises to intensify technical filtering measures and strengthen information security systems. Resolutely block the websites of foreign hostile forces, strike hard at domestic online bookstores and electronic commercial platforms that act as go-betweens for overseas harmful publication activities, strive to increase the investigation and prosecution of those spreading politically harmful publications using mobile apps, "Great Firewall circumvention" software, social media, and weibo. Move quickly to block, delete, investigate and prosecute political illegal websites, political illegal  online publications, and harmful information. Absolutely do not permit any online retention or diffusion. Build extensive systems for gathering and reporting important information, joint investigation of important clues, and supervising the investigation of important cases.

苏州市相城区查堵反制香港反动出版活动专项治理“清源”行动工作方案

根据省、市“扫黄打非”工作领导小组办公室的统一部署和《苏州市相城区2013年“扫黄打非”行动方案》要求,决定自5月下旬至10月中旬,在全区范围内组织开展深化查堵反制香港反动出版活动专项治理“清源”行动。现制定方案如下:
一、行动目标
按照抓源头、打基础的工作要求,以狠抓进境查堵、邮运验视、印刷监管、市场清查、网络监管、对内约束、综合反制为主要方式,以案件查办为抓手,网上与网下治理相结合,开展深化查堵反制香港反动活动专项治理“清源”行动,务求通过专项治理,确保不发生政治性有害出版物批量进境现象,不发生有规模的承印和盗印政治性有害出版物现象,不发生政治性有害出版物及相关信息网上扩散现象,不发生政治性有害出版物重要事件和事件查办不力现象。
二、工作措施
(一)加强进境查堵。加强封堵政治性非法出版物进境治理工作,重点查处携带违禁出版物进境的行为,认真贯彻《关于严禁党员干部在境外出版发表政治性有害出版物和文章及携带有害出版物入境的通知》要求,督促出境游组团社落实对游客的提示、引导、劝阻等措施。
(二)加强邮运验视。严格规范物流运输渠道,督促物流企业、仓储场站以及高速铁路等承运环节健全检查核验机制。特别要提高对来自香港的邮递物品、旅客行李物品、快速物品和各类运输货物的机检率,发现嫌疑的一律开包检验。完善对非法出版物物流渠道封堵的工作机制。
(三)加强印刷监管。大力推进企业合法性,经营规范化、管理责任制三项基础性管理工作,充分发挥江苏省委托印刷业务网上备案系统的作用,进一步完善印刷复制企业台账管理和有关管理制度。对有违法违规记录的、举报线索指向较多的、承接境外印刷业务和具有出版物印刷能力的印刷企业进行重点检查,尤其要加强对为香港出版活动提供印刷装订等服务的印刷企业监管,坚决取缔非法印刷复制“黑窝点”。
(四)加强市场清查。进一步加大对出版物市场的监管力度,采取联合检查、错时检查、暗访检查、交叉检查等方式,督促出版物集中销售场所和批发、零售单位规范进货渠道,严格落实有关进销管理规定,坚决查处收缴政治性非法出版物。对繁华街区、旅游景点、交通枢纽等重点部位保持日常巡查的高压态势,坚决取缔兜售非法出版物的游商地摊和无证照经营者。
(五)加强网络监管。加强对互联网、移动通信的基础管理,督促电信运营企业强化技术过滤手段,健全信息安全制度。坚决封堵境外敌对势力网站,严厉打击境内网络书店、电子商务平台等代购境外有害出版物行为,切实加大对利用移动智能终端、“翻墙”软件、社交网络、微博客等手段传播政治性有害出版物的查处力度,对政治性非法网站、政治性非法网络出版物及有害信息要及时予以屏蔽、删除、查处,决不允许在网上滞留和扩散,建立健全重要信息汇总通报、重要线索联合核查、重点案件协查督办等工作机制。

On June 23, the National "Sweep Away Pornography and Strike Down Illegal Publications" Task Force Office convened the second major inspection of Mosques and other religious venues and their neighboring publications markets in order to strengthen the clean up of mobile phone and computer retail and repair markets, strengthen the governance of printing, copying, and typesetting shops, transportation, and mail delivery links, and eliminate harmful publications. The first major inspection of printing enterprises and publication markets was carried, with resolute investigations and prosecutions of those who published books and materials on behalf of Hong Kong publishers.

During the "Tianshan Project" operation, the Ningxia "Sweep Away Pornography and Strike Down Illegal Publications" Office and the Yinchuan Customs Bureau investigated and prosecuted illegal political publications that had originated from Hong Kong and Taiwan. There were no illegal religious publications relating to Xinjiang or  Tibetan independence. Yinchuan is a major point of ingress for illegal publications, and currently the only means employed to bring in illegal publications is tourists carrying them in in their luggage. Illegal publications include books and magazines, and consist mainly of illegal political books such as "The Zhongnanhai Episode," and magazine such as "Xinwei Monthly," "Major Incidents," "Trends," etc.

6月23日,全国“扫黄打非”工作小组办公室召开展2次清真寺等宗教场所及其周边出版物市场大检查、加强手机、电脑销售和维修市场的整治、加强印刷复制企业和打字复印店、交通运输、邮政寄递环节的治理,清除有害出版物;对全区印刷企业和出版物市场进行一次大检查,坚决查处以香港出版机构名义出版的图书和资料;

在“天山工程”专项行动中,宁夏“扫黄打非”办公室与银川海关查处的非法政治性出版物基本上来自香港和台湾。没有涉疆、涉藏非法宗教类出版物。宁夏银川市是非法出版物的进入重点,目前,只有旅客以旅行箱内夹带的方式将非法出版物带入,非法出版物有图书及杂志,主要是非法的政治性图书,如《中南海轶事》,杂志《新维月刊》、《大事件》、《动向》等。

The focus throughout the entire year was to ban, block, inspect, confiscate, and counter overseas political illegal publications, particularly those from Hong Kong. The focus was on uncovering and blocking reactionary propaganda from Falun Gong groups and politically harmful publications such those that made outrageous statements critical of Party personnel arrangements, that spoke unfavorably about Party and State leaders, and sowed disorder in the public's ideology, and that advocated for "Tibetan Independence" and Xinjiang separatism. The goal was to ban these from entering from overseas and being published domestically,  illegally printed, sold in markets, spread online, and discussed in the media.

Baidu and Sina Weibo Censor Search Results About Hong Kong Bookseller Lam Wing-kee

Shortly after 3:00 am on June 17, 2016, the state sponsored Global Times published an editorial entitled "Causeway Bay Bookstore Boss' Retraction' Has Little Factual Content" (铜锣湾店长“翻供”的实质内容不多). Some excerpts:
Lin Rongji (Lam Wing-kee), one of the "disappeared" booksellers of Causeway Bay, held a press conference on the 16th after having returned to Hong Kong. He adopted a posture of "retracting his confession" and created a lot of waves in Hong Kong public opinion.

Lin Rongji related details of how he was detained last year on October 24 at Luowu, Shenzhen, and then transferred by train to a "holding place" in Ningbo. He asserted that Causeway Bay bookshop owner Li Bo (Lee Po ) had been subjected to a "cross-border rendition" and abducted from Hong Kong by mainland Chinese law enforcement officials. This differs from the account provided by Li Bo.

He also said that  his own "televised confession" was "scripted," and he had been forced to cooperate.

Lin said "Mainland China's central government is forcing the people of Hong Kong down a path with no escape," and "The people of Hong Kong must say 'no' to coercion." These two statements were widely quoted, and were thick with emotion.

林荣基讲述了他去年10月24日经罗湖回深圳后被拘留,后坐火车转到宁波“监视居住”的细节。他断言铜锣湾书店李波是被内地执法人员“跨境执法”从香港捉拿带走的,这与李波本人的说法不同。他还说自己“电视认罪”时“有导演有台词”,自己被迫配合。
  
林说“中央政府逼到香港人无路可退”,又说“港人向强权说不”,这两句话被广泛引用,情绪味很浓。

Later that evening the Global Times published another article about Lam, this time entitled “Shareholder Lee Bo Refutes What Causeway Bay Bookstore Boss Said in Press Conference” (股东李波反驳铜锣湾书店店长记者会说法).

These screenshots show that at the same time Sina Weibo stopped including users posts in search results for Lam’s name, instead only displaying the Global Times’ article refuting his claims.

The screenshots below show that on June 17, Baidu began censoring web search results for "Lam Wing-kee" (林荣基). Although Baidu has stopped notifying users of its censorship, one can see that, prior to 2:30 pm on the 17th, a search for "Lam Wing-kee" returned tens of thousands of results, including results from news websites located outside of mainland China such as:
  • Phoenix (HK)
  • Tsingtao Daily (HK)
  • Takungpao (HK)
  • Tsingtao News Network (HK)
By 11:00 pm the same day, Baidu claimed it could find only 18 results, and they were all from websites operated by agencies of China's central government:
  • Youth.cn (Communist Youth League)
  • Xinhua (China’s Official News Agency)
  • People’s Daily (Official Party Mouthpiece)
  • China News Agency (China’s 2nd Largest State-Owned News Agency)
  • China Daily (China’s Official English Language Newspaper)
  • China.com.cn (Operated by China’s State Council Information Office)
  • Taiwan.cn (Operated by the State Council’s Taiwan Affairs Office)


These screenshots show that at the same time Baidu began censoring web search results, it also began claiming it could no longer find any Weibo related search results.

Lawyer Yuan Yulai Sues Government For Confiscating Books

On March 8, 2016, the state sponsored Global Times published an article entitled “Publication Watchdog Sued Over Book Seizure.” Some excerpts:
A lawyer from East China's Zhejiang Province sued the local publication watchdog on Monday after 14 books that he bought online and that were published by Taiwan or Hong Kong publishers - some of which are about the Bible, Marxism and North Korea - were confiscated on suspicion that they were "illegal publications."

Yuan Yulai, a lawyer at Zhejiang Zhixing Law Firm who has taken on several cases against government bodies, told the Global Times on Monday that he has filed his suit with the People's Court of the Beilun District in Ningbo, Zhejiang and will receive a reply within seven days.

According to Yuan, five people including law enforcement officers from the culture, radio, television, news and publication bureau of Ningbo's Jiangdong district and local police officers came to his office on March 4 and informed him that books in an unopened package were illegal publications. Despite his protests, the officers opened the package and confiscated all 14 books.

A search of Chinese e-commerce website taobao.com showed that some of these books were still sold on the platform as of press time.

Yuan is also known as an online celebrity who had over 20 million Sina Weibo followers before his account was shut down in late 2015. He started an online campaign in April 2013 encouraging people to stop visiting the town of Fenghuang, a popular tourist destination in Xiangxi Tujia and Miao Autonomous Prefecture in Central China's Hunan Province, after local authorities began charging entry fees to the town, prompting a backlash among local store owners.
On March 9, 2016, the Global Times published an article entitled “Local Govt Says Book Seizure was Lawful Operation.” Some excerpts:
The local district government in Ningbo, East China's Zhejiang Province said Tuesday that the local publication watchdog's confiscation of a lawyer's books on suspicion that they were "illegal publications" was a regular law enforcement operation and the results of the investigation will be released through proper channels.

Yuan argued that the operation's procedure was illegal because the law enforcement officers confiscated the books, which goes against the country's Law on Administrative Penalty.

According to that law, administrative organs may obtain evidence through sampling. Under circumstances where it is likely that the evidence may be destroyed, lost, or difficult to obtain at a later point, administrative organs may - with the approval of their leading members - first register the evidence for preservation and make a timely decision on its disposition within seven days. 

"If they had merely registered the evidence for preservation, I would still have these books in my hand and would have no need to file a lawsuit," said Yuan.
This screenshot was taken on March 13, 2016, and shows that Taobao would not allow users to find results for "The Girl With Seven Names," one of the books confiscated from Yuan's offices.

This screenshot shows, however, that the same search with the final character removed returns many results.

Administrative Lawsuit in the Hong Kong Taiwan Book Confiscation Case

Plaintiff: Yuan Yulai, Male, Born May 18, 1966, Han ethnicity, Star of Zhejiang Law Firm, Residing at 4th Floor, Meibai Apartments, No. 655 Zhongxing Road, Ningbo.

Defendant: Administration for Culture and Radio, Television,  News, and Publishing of Jiangdong District, Ningbo, Located at No. 8 Yanwu Street, Ningbo.

Legal Representative: Wang Yu, Director.

Request for Relief:

Rescind the (Yongdong) Culture\Broadcasting\News Cert. Doc. (2016)#1 Notice of Preliminary Registration and Retention of Evidence issued by Defendant on March 4, 2016, and order Defendant to immediately return the 14 confiscated books to Plaintiff.

Statement of Facts:

At around 11:00 am on March 4, 2016, five individuals comprising the Defendant accompanied by the police did, without permission of the Plaintiff, suddenly enter the Plaintiff's office. Only one individual carried any law enforcement credentials, while the others did not produce any law enforcement credentials. One of these was a police officer with whom the Plaintiff had had previous work-related contact.

The Defendant and law enforcement agents said that during a joint law enforcement action it was discovered that the Plaintiff was suspected of purchasing and storing illegal publications, and afterwards produced a package, saying that it contained illegal publications.

When the Defendant decided to unseal it, they met with the stern refusual of the Plaintiff, and the Plaintiff demanded the Defendant produce their legal basis. Nevertheless, over the express objections of the Plaintiff, the policies officers forced the package to be opened.

Afterwards, after the Defendant had finished writing out a record, they produced the (Yongdong) Culture\Broadcasting\News Cert. Doc. (2016)#1 Notice of Preliminary Registration and Retention of Evidence and a Preliminary Statement of Evidence Registration and Retention, and confiscated the 14 books that were in the package.

The Plaintiff believes that the actions of the Defendant in confiscating the Plaintiff's books was without factual or legal basis, and severely infringed upon the rights of the Plaintiff:

(1) Lack of Factual Basis.

(i) The Defendant claims that the books discovered during the joing law enforcement inspection were illegal publications. The Plaintiff's package had not, however, been opened, and there was no way for the Defendant to have determined the contents were illegal publications.

When being interviewed the Defendant claimed, "Specifically, there were other clues there, you should ask the police, as it was the police that called us to go over there with them and take joint action." This is a dereliction of duty and an abuse of authority. The Defendant should have acted in accordance with the facts and the law, and not blindly follow or submit to the will of another agency.

(ii) Even if the books in question were illegal publications, the Defendant and the police conducted an illegal inspection by forcefully opening the Plaintiff's package to obtain evidence, and it cannot be used to prove the legality of the administrative action that is the subject of this lawsuit.

In this case the criteria for a fored inspection and search of the Plaintiff's package were lacking, as the Plaintiff was not under suspicion of endangering state security or committing a crime. Article 40 of the Constitution of the People's Republic of China clearly states: "The freedom and privacy of correspondence of citizens of the People's Republic of China are protected by law. No organization or individual may, on any ground, infringe upon the freedom and privacy of citizens' correspondence except in cases where, to meet the needs of state security or of investigation into criminal offenses, public security or procuratorial organs are permitted to censor correspondence in accordance with procedures prescribed by law."

Clause 3 of Article 43 of the Administrative Litigation Law clearly states: "Evidence that has been obtained illegally may not be used as the basis for determining facts in a case."

(iii) The Books in Case Were not Illegal Publications

First, the books were published legally by Hong Kong and Taiwan publishers, and the Plaintiff purchased them legally from a Taobao website bookstore, and the online bookstore should have had an operating license. The latter should have been examined by Taobao, and based on the Plaintiff's understanding, Taobao should also have been inspected. In the Plaintiff's own defense, the Defendant's law enforcement officers themselves did not know whether mainland Chinese online and brick-and-mortar book stores could legally sell books published in Hong Kong or Taiwan. Their ignorance is shocking.

Second, looking only at the title of the books, there is no problem with the content of these books, and they are no so-called banned books. Several can be seen as being a positive force, and the Plaintiff had closely reviewed them prior to purchase.

"A Guide to Understanding the Bible's Old and New Testaments" and "The 100 Bible Events That Influenced the World" relate to the Bible.

"The Girl With Seven Names," "The Man With No Name," "I Want to Live Like a Man," and "Heaven" all discuss matter in North Korea.

"The Flowing Waters Never Revealed the Truth" is about the Cultural Revolution.

"Hidden Power" discusses historical events.

"Night: A Memoir of a Nazi Concentration Camp" is about Nazis.
"Thoughts on Law Enforcement" is the recollections of the judicial reform period by Taiwan prosecutor.

"Team of Rivals: The Political Genius of Abraham Lincoln" is a story about Lincoln.

"Heeding Marx in the Face of the Capitalist Catastrophe," "Who Says Democracy is not Subjugating," "Cai Yingwen Cannot Get Around the Republic of China" can be seen as being positive forces. The first promotes Marxist thought, the second opposes placing excessive faith in democracy, and the third is, after all, anti-Taiwan independence.

Nevertheless, the Defendant confiscated all of them over the express objections of the Plaintiff.

(2) Lack of Legal Basis

In its Notice of Preliminary Registration and Retention of Evidence the Defendant determined that the Plaintiff was suspected of "purchasing and storing illegal publications," but failed to clarify which law stipulates investigation and prosecution of consumers who purchase so-called banned books. This is a classic example of misapplication of the law. As far as the Plaintiff is aware, there is no such legal provision.

This lawsuit is filed based on the foregoing. It must be explained that this case implicates issues of extreme importance. First, if  individuals' letters and packages can be inspected arbitrarily and capriciously and forced open, then people will be unable to go about their work and lives, and no one in our society will feel secure.

Second, if books from Hong Kong and Taiwan may be arbitrarily and capriciously deemed to be illegal publications and prohibited from being purchased by people in the mainland, then cultural exchanges across the strait will not be able to continue in a normal fashion, which will have an impact on the grand enterprise of the unification of the fatherland.

港台图书被查扣事件行政起诉状

诉讼请求:

撤销被告2016年3月4日作出的(甬东)文广新证通字(2016)第01号先行登记保存证据通知书,责令其及时将扣押的14本书籍返还给原告。

事实和理由:

2016年3月4日11时许,被告偕同公安民警共计5人,未经原告准许,忽然进入原告办公室。只有一位佩戴着执法证,其余几位未出示执法证。 其中一位系公安局民警,原告曾经有过工作上的接触。

被告执法人员说是在联合执法中,发现原告涉嫌购买贮存非法出版物,然后有人拿进来一个包裹,说里面是非法出版物。

被告决定拆封时,遭到原告严词拒绝,原告要求被告出具法律依据。但是,在原告的抗议声中,同行的公安民警还是强行拆开了包裹。

随后,被告在制作笔录后,出具了(甬东)文广新证通字(2016)第01号先行登记保存证据通知书和先行登记保存证据清单,扣押了包裹内的14本书。

原告认为,被告查扣原告书籍行为没有事实和法律依据,严重侵犯了原告的权利:

一、没有事实依据。

1、被告称是在联合执法检查中发现包裹里的书是非法出版物,可是原告的包裹尚未打开,被告根本无法认定其中是非法出版物。

被告在接受记者采访时称,“具体的,还有线索那边,要问公安,是公安叫我们一起过去,联合行动”,这是玩忽职守、滥用职权。被告应该根据事实和法律依法行政,而不应该盲从或者屈从其他机关的意志。

2、即使涉案书籍是非法出版物,被告或者公安民警非法检查、强行拆封原告包裹取得的证据,也不能用来证明所诉行政行为的合法性。

本 案不具备强行检查、搜查原告包裹的条件,原告并无危害国家安全也未涉嫌刑事犯罪。《中华人民共和国宪法》第40条明确规定:“中华人民共和国公民的通信自 由和通信秘密受法律的保护。除因国家安全或者追查刑事犯罪的需要,由公安机关或者检察机关依照法律规定的程序对通信进行检查外,任何组织或者个人不得以任 何理由侵犯公民的通信自由和通信秘密。”

《行政诉讼法》第43条第3款明确规定:“以非法手段取得的证据,不得作为认定案件事实的根据。”

3、涉案书籍并非非法出版物。

首先,这些书是港台出版社合法出版的,原告是从淘宝网上的书店依法购买的,网上书店应该是有经营许可证的。后者应该由淘宝网进行审查,据原告了解,淘宝网也是经过审查的。
在原告申辩过程中,被告执法人员竟然不知道大陆的网上书店和实体书店可以依法出售港台书籍,其无知实在让人震惊。

其次,单从书名来看,这几本书的内容都没有问题,也不是所谓的禁书。有几本则堪称是正能量,原告下单之前是经过认真审查的。
《新 旧约圣经轻松读》、《影响世界的圣经100大事件》是有关圣经的,《拥有七个名字的女孩》、《没有名字的人》、《我想活得像个人》 、《天堂》讲的是朝鲜 的事情,《流水何曾洗是非》是反思文革的,《隐动力》讲的历史故事,《夜:纳粹集中营回忆录》讲的是纳粹,《执法所思》是一位台湾检察官对司法改革年代的 回顾,《无敌:林肯不以任何人为敌人创造了连政敌都同心效力的团队》讲的是林肯的故事。

《在资本主义带来浩劫时聆听马克思》、《谁说民主不亡国》、《蔡英文绕不绕得过中华民国》三本则堪称正能量,第一本是弘扬马克思思想的,第二本是反对过分迷信民主,第三本则显然是反台独的。

可是,被告在原告的异议声中,竟然全部都扣押了。

二、没有法律依据。

被告在先行登记保存证据通知书认定原告涉嫌的是“购买贮存非法出版物”,但没有明确什么法律规定了消费者购买所谓的禁书可以予以查处,这是典型的适用法律错误。而根据原告所知,也没有这样的法律规定。

综 上所述,特提起诉讼。不能不说明的是,本案涉及的问题特别重要,首先个人的信函和包裹如果能够随便检查、强行拆封,人们就无法正常生产、生活,社会就会人 人自危。其次,如果随便将港台书籍认定为非法出版物而不准在大陆民众购买,两岸的文化交流就无法正常,进而会影响祖国统一大业。
